Welcome to Skill Mentor BD's e-learning platform. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and courses (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms and all policies referenced herein. If you do not agree to these Terms, please do not use our Platform.
1. Acceptance of Terms
By creating an account, enrolling in a course, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Skill Mentor BD.
2. User Accounts
a. Account Creation:
To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
b. Account Security:
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify Skill Mentor BD immediately of any unauthorized use of your account or any other breach of security. Skill Mentor BD will not be liable for any loss or damage arising from your failure to comply with this security obligation.
c. Eligibility:
You must be at least 13 years old to create an account and use our Platform. If you are under 18, you represent that you have obtained parental or guardian consent to use the Platform and agree to these Terms.
3. Course Enrollment and Access
a. Course Access:
Upon successful enrollment and payment (if applicable), you will be granted a limited, non-exclusive, non-transferable license to access and view the course content for which you have paid, solely for your personal, non-commercial educational purposes.
b. Course Content:
Course content may include videos, text, quizzes, assignments, and other materials. The availability of specific course content may vary. Skill Mentor BD reserves the right to modify, update, or discontinue any course or content at any time.
c. Refunds:
Our refund policy is outlined separately [Link to Refund Policy, if applicable, otherwise remove or state no refunds]. Please review it carefully before making any purchases.
4. Intellectual Property Rights
a. Ownership:
All content on the Platform, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the property of Skill Mentor BD or its content suppliers and is protected by intellectual property laws.
b. Limited License:
You are granted a limited, revocable, non-transferable, and non-sublicensable license to access and use the Platform and its content for your personal, non-commercial educational purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as generally permitted by the Platform's functionality.
c. User Content:
You may be able to submit content to the Platform, such as comments, forum posts, or assignment submissions ("User Content"). You retain ownership of your User Content, but by submitting it, you grant Skill Mentor BD a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Platform and Skill Mentor BD's business.
5. Acceptable Use
You agree not to use the Platform to:
Violate any applicable local, state, national, or international law or regulation.
Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
Submit false or misleading information.
Upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Platform or of any related website, other websites, or the Internet.
Collect or track the personal information of others.
Spam, phish, pharm, pretext, spider, crawl, or scrape.
For any obscene or immoral purpose.
Interfere with or circumvent the security features of the Platform or any related website, other websites, or the Internet.
6. Disclaimer of Warranties
The Platform and all content, materials, and services provided on or through the Platform are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Skill Mentor BD does not warrant that the Platform will be uninterrupted, error-free, secure, or that any defects will be corrected.
7. Limitation of Liability
In no event shall Skill Mentor BD, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
8. Indemnification
You agree to defend, indemnify, and hold harmless Skill Mentor BD and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Platform, by you or any person using your account and password; b) a breach of these Terms, or c) content posted on the Platform.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of [Your Country/Region, e.g., Bangladesh], without regard to its conflict of law provisions.
10. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
